BART’s BATUSHKA Hints At One Of “The Final Chances” To Watch Them Live


Batushka – led by singer Bartłomiej Krysiuk – appears to be preparing for a potential transformation. As per Batushka‘s Instagram page, they will be live streaming their performance on September 20 in Poland, which presents “one of the final chances to catch Batushka in concert.”

When prompted about the significance of the “final chances” statement, the band enigmatically replied: “it will be something NEW!” Perhaps now is the time to reflect on the recent legal battle that Krysiuk is losing against Batushka founder Krzysztof “Derph” Drabikowski, and how it seems likely that Krysiuk‘s iteration of Batushka will lose its moniker.

Drabikowski and Krysiuk went their separate ways in 2018, with Drabikowski moving forward as Batushka without Krysiuk. Eventually, it was Krysiuk who continued as Batushka and inked a deal with Metal Blade for the 2019 album Hospodi. Krysiuk has now signed with Napalm Records for another release sans Drabikowski under the Batushka banner, all while extensively touring.

Drabikowski pressed on as Батюшка and put out an album titled Панихида in 2019, as a legal dispute simmered in the background over the ownership of the Batushka name.

Then came the recent ruling that Drabikowski holds the rights to the name, and that Krysiuk cannot continue as Batushka without Drabikowski‘s approval. As Krysiuk mentioned in his statement, he and his band intend to challenge the verdict, and until the appeal is either accepted or rejected, his version of Batushka will persist under the same moniker.

Krysiuk stated: “In light of the ruling by the District Court in Warsaw, XXII Intellectual Property Division, we wish to announce that the ruling is not final and is subject to appeal. We are disheartened by the judgement and the protracted trial, spanning over four years.

“Our disappointment is compounded by the perceived lack of adequacy in the evidence we presented. The aforementioned court ruling is not definitive and does not impinge on our current concert and release plans in the immediate future.

“It is worth noting that final legal rulings are binding, i.e., those unopposed within the stipulated timeframe of the proceedings. Should a final judgement be pronounced in further legal proceedings, we will duly acknowledge and comply with it.

“Of course, we anticipate a fresh wave of backlash, so we urge our fans to abstain from fruitless debates and instead, immerse yourself in our music and show your support.

Drabikowski‘s statement, emanating from the official ruling in Poland, reads as follows.

“On May 29, 2024, in Warsaw, during a non-publicised hearing pertaining to the litigation between Krzysztof Drabikowski and Bartłomiej Krysiuk concerning the safeguarding of personal rights within the realms of promotion or advertisement, copyright protection, and the counterclaim from Bartłomiej Krysiuk against Krzysztof Drabikowski concerning the protection of personal rights in promotion or advertisement, the prevention of unfair competition, and the infringement of the right to the registration of a European Union trademark; the court, in its primary ruling, prohibits Bartłomiej Krysiuk, without the explicit consent of Krzysztof Drabikowski, from utilising the name ‘Batushka or Батюшка‘ in his musical endeavours, encompassing the branding of musical recordings and audiovisual content containing musical recordings; Furthermore, the directive restrains the defendant Bartłomiej Krysiuk from disseminating falsehoods asserting his sole ownership of the name ‘Batushka or Батюшка‘ and denying Krzysztof Drabikowski‘s legitimate claim to the name.”
