The inaugural “Tool Live In The Sand” destination festival, held on the beaches of Punta Cana, Dominican Republic, has been marred by significant fan dissatisfaction, potentially culminating in a class-action lawsuit. The event, headlined by TOOL, promised attendees “two unique headlining sets” across two nights, March 7th and 8th. However, many fans felt the band failed to deliver on this promise.

Despite the premium pricing associated with the destination festival, which included travel and accommodation, TOOL presented remarkably similar setlists on both nights. Notably, they played the same four songs – “Fear Inoculum,” “Rosetta Stoned,” “Pneuma,” and “Jambi” – during both performances. This lack of variation, particularly in a festival setting where attendees expect diverse sets, triggered widespread disappointment.

The frustration reached a boiling point during the second night’s performance. After realizing the band was repeating a significant portion of the previous night’s set, some attendees began to boo, expressing their discontent audibly. This reaction highlighted the depth of the fans’ disappointment.

Following the festival, an advertisement began circulating on Facebook, purportedly from a lawyer seeking individuals interested in joining a class-action lawsuit against TOOL, ThePRP reports. The advertisement alleges that the band’s repeated setlists constituted a breach of the festival’s promise of “two unique headlining sets.” A screenshot of this advertisement has also been shared on Reddit, further amplifying the issue. The lawsuit aims to address the financial and emotional distress experienced by fans who felt they were misled by the festival’s promotional materials.

Essentially, the core complaint is that what was advertised did not match the delivered product, leading to a potential legal challenge.
